1. Acceptance

By using chat.logfare.ai anonymously or with an account, you agree to these Terms. If you do not agree, do not use the Service.

2. Three-Tier Access Model

Your access and data-handling posture depends on which tier you're in:

• Anonymous: Free-tier models only. Your data is never sold.
• Account (default): Free-tier models + conversation sync. Your data is still never sold.
• Account + Financial Incentive opt-in: Premium models unlocked. Best-effort anonymized derivatives of your content may be included in datasets we sell or license. See Privacy §3a and §3b.

Anonymous sessions cannot self-upgrade to the selling tier — you need an account so we can honor your downstream rights (deletion, opt-out, rectification).

3. Eligibility — 18+

The Service is available only to individuals aged 18 or older (16 or older in the EEA with parental consent). You confirm this below.

4. No Uptime Guarantees

The Service is provided "AS IS" without warranty. We make no guarantees about uptime, output quality, model availability, or latency.

5. Data Collection — Summary

Every message is logged for service operation. IP addresses, User-Agent strings, and headers are retained at most 90 days and are never included in any sold dataset, regardless of consent. Full detail at /privacy.

6. Prohibited Use

You agree not to:

• Generate illegal content, harassment, or CSAM
• Submit third-party personal information without consent
• Submit credentials, API keys, or sensitive authentication data
• Submit data regulated under HIPAA / GLBA / FERPA / PCI-DSS
• Submit GDPR Article 9 special-category data — including health, sexual orientation, religion, political opinions, biometric, or genetic data (yours or others'). Talk to a qualified professional, not a chatbot.
• Generate spam, scam, or content optimizing for self-harm
• Impersonate individuals or organizations
• Use automated/bot traffic without prior disclosure
• Interfere with infrastructure or attempt to access internal systems

7. Fair Use & Termination

Fair use applies — abusive automated traffic may be throttled or blocked. We may terminate any session or account at any time. You may delete yours at Settings → Privacy.

8. Liability

To the maximum extent permitted by law, we are not liable for any damages arising from use of the Service. You indemnify us against claims arising from your use or violation of these Terms.

9. Governing Law

Wyoming, USA, except where mandatory consumer-protection law (CCPA for California, Privacy Act 1988 for Australia, GDPR for EEA) applies.

10. Changes

We may update these Terms. Material changes get reasonable advance notice.
